Curaçao Expands Rules On Operator T&Cs

Curaçao’s gambling regulator has introduced a detailed set of requirements aimed at reshaping how licensed operators present and enforce their terms and conditions, marking a shift toward tighter oversight.

The updated policy follows the approval of the island’s new regulatory framework at the end of 2024. It outlines a broader set of obligations for B2C license holders, extending beyond earlier guidance and requiring alignment with the latest standards.

Authorities intend for the changes to bring Curaçao’s framework closer to practices seen in more tightly regulated jurisdictions. Operators have been given a transition window before the measures take effect in October.

Clearer Presentation And Player Consent Rules

A central focus of the policy lies in improving how terms and conditions are communicated to users. Operators must ensure continuous visibility and accessibility of their rules across all platforms.

The guidelines state that the: “current version of the T&Cs must be made available to players at all times in a clear and readable form across all websites, mobile platforms and other delivery mediums.”

The document also requires that earlier versions be accessible upon request, with updates clearly identified. Operators must avoid ambiguous language and ensure internal consistency across all policies tied to their services.

Player consent procedures are also being tightened. Passive acceptance methods will no longer meet the required standard. Users must actively confirm agreement during registration, and material updates will require renewed approval.

The policy further mandates that operators keep records of player acknowledgements and maintain a historical archive of all versions of their terms.

Stronger KYC and AML Transparency Requirements

The revised framework places greater emphasis on how operators disclose identity verification and financial monitoring practices.

Licensees must explain in advance how customer checks will work, including what documentation may be required and when verification processes will occur. The aim is to prevent situations where additional requirements are introduced when a player attempts to withdraw funds.

The same level of clarity applies to anti-money laundering and counter-terrorism financing measures. Operators must outline how transactions are monitored and inform users that suspicious activity may be reported to relevant authorities.

The policy also requires transparency around data handling, including how personal information is collected, stored, and retained in line with applicable regulations.

Compliance Expectations And Potential Penalties

The updated rules limit the level of discretion operators previously held when drafting and applying their terms.

Failure to comply may lead to regulatory action. Measures outlined in the policy include directives to amend non-compliant terms, administrative penalties, and the possibility of licence suspension or revocation.

Before taking enforcement action, the regulator may first instruct operators to correct deficiencies within a specified timeframe.

The policy also introduces detailed expectations across areas such as account closures, bonus conditions, dispute resolution, and the handling of player funds. Operators must clearly define processes for withdrawals, including timelines, verification requirements, and restrictions.

In addition, licensees must disclose key corporate information, specify the governing jurisdiction for disputes, and clarify which services fall under regulatory oversight.

The new framework is scheduled to take effect six months after its release, giving operators time to revise their policies and submit updated documentation for approval.
